It is apparent that the DDA has impleaded in
the case 144/2013. The High Court Order No.
EA(OS) Nos. 670/2013 (Stay of auction) and 671/2013 (impleadment) filed by
DDA was
passed by the very same judge who had ordered the auction. The order is dated
29th Oct 2013 and reply has to be submitted within two weeks i.e. by 12th Nov
2013 (Tomorrow). This order was not
known to us at the time of auction. In this connection the proceedings as
recorded by Mr. Kafeel Ahmed may be reviewed.
On 11 Nov 2013, the
Society received legal notices from successful bidders demanding relevant
papers pertaining to Flat Nos. 53 & 164 (Possession & Share
Certificates etc).
It
is strongly recommended that the Managing Committee consult the Society’s
lawyer at once for the reply to be submitted in High Court well in time and
avoid taking any precipitate irreversible action before a decision by the
High Court.
It
is clear that opponents of the High Court ordered auction of flats have managed
to create an avoidable situation.
